We help put the ‘fair’ back in ‘fair fight’

California Government Code Section 12940 makes it illegal to discriminate against someone in employment on the basis of a host of protected personal characteristics, including sexual orientation. In 2004, protection was extended in the Fair Employment and Housing Act (FEHA) to members of the transgender community.

FEHA covers claims for:

  • Employment discrimination
  • Harassment
  • Housing discrimination
  • Retaliation (such as demotion or wrongful termination of persons who have been the victims of discrimination)
  • Denial of medical leave or pregnancy leave

If you have been the victim of illegal discrimination in violation of your rights under the Fair Employment and Housing Act, you must file a complaint with the Department of Fair Employment and Housing (DFEH) or the Equal Employment Opportunity Commission (EEOC).

Generally, there is a one-year statute of limitations. You must bring your lawsuit within one year of the last act of illegal discrimination or harassment.

Every case is different so you should always talk to an attorney about your specific situation to learn what the statute of limitation is for you and whether you should proceed with your claim through the DFEH process or the federal EEOC. In many cases, California’s laws offer greater protection.

When you file a claim, you will need to identify all of the people who treated you unfairly and what they did. Make sure you are thorough in describing every event and detail in your claim because you cannot add additional claims later on, at trial.

The DFEH will either investigate your claim and attempt to mediate your case, or you can request an immediate “right to sue” letter, which allows you to proceed with a lawsuit. You must have a right to sue letter before bringing a lawsuit or your case could be thrown out.

This is a specialized field of law. Many lawyers do not understand the pre-filing requirements. The Dolan Law Firm Fair Employment and Housing Act attorneys are skilled in navigating these regulations. If your case is selected by The Dolan Law Firm, we will guide you through this process. We have extensive experience bringing — and winning — discrimination cases in court. See a few of our representative cases.

Our lawyers work on a contingency meaning that you pay no fees or costs upfront. If we obtain a recovery on your behalf, we receive a percentage of any recovery we obtain for you. No recovery, no fee.

If you believe that you are being discriminated against or harassed at work or in housing or accommodations because of your sexual orientation, contact The Dolan Law Firm for a free case evaluation. Speak with a San Francisco LGBT housing discrimination lawyer today.
